青岛大学硕士学位论文论我国驰名商标的司法认定姓名:郑成勇申请学位级别:硕士专业:诉讼法学指导教师:于正河 20080605 论我国驰名商标的司法认定摘要驰名商标是极为重要的知识产权,它是企业重要的无形资产,也是国之瑰宝, 代表着高品质的商品质量和良好的商业信誉。正确认识、依法认定驰名商标是有效保护驰名商标的前提。2001年7月最高人民法院颁布实施<关于审理涉及计算机域名民事纠纷案件适用法律若干问题的解释》,第一次明确规定了人民法院有权对驰名商标进行认定。{:商标法》修订以后,最高人民法院又及时制定了审理商标民事纠纷案件的司法解释,对认定驰名商标的法院、认定驰名商标的主体、认定的标准、效力以及对侵犯驰名商标法律责任的追究等作了更具体的解释。但在目前知识产权商标纠纷司法实践中,驰名商标的司法认定是讨论比较多的话题,也是出现问题比较多的领域,以致于有的学者对驰名商标司法认定方式提出质疑和否定。本文从我国驰名商标认定的现状开始,先从理论上分析驰名商标司法认定的可行性,再探讨驰名商标司法认定的原则、更为具体的标准以及司法认定驰名商标的情形,最后从诉讼程序等角度对完善我国驰名商标司法认定进行完整的思考。关键词:驰名商标;司法认定:完善 STUDY ON JUDICATURE RECOGNIZED TRADEMARKS INCHINA Abstract Well—known trademark is one kind ofimportant intellectualproperty;it is an essential intangible property oftheenterprises andprecious wealth ofthe forthehigIl quality ofproducts mercial andconfirming well-known trademarks inlegal and proper way isthe requisite of protection on well- July,200 1,The Supreme People Court promulgates and implements‘'The JudicialInterpretation ofLegal Utilization puter Domain Name inCivilDispute Case",in which explicitlystipulated thatthecourt haseertain right tocarry onwell—knowntrademark ‘'Trademark Law'’revises.
