第一章 总 则
第一条 为加强农村宅基地管理，规范农村建设用地秩序，保护农村村民的合法权益，根据《中华人民共和国土地管理法》（以下简称《土管法》）、《山东省实施〈中华人民共和国土地管理法〉办法》等有关规定，结合我市实际，制定本办法。
第二条 本市范围内的农村宅基地管理，适用本办法。
第三条 本办法所称农村宅基地，是指农村村民个人经依法批准，用于建造住宅（包括住房、附属用房和庭院等）的集体所有土地。
第四条 对城市规划区内的农村村民住宅建设，应当按照城市规划，进行旧村改造，集中兴建农民住宅小区。对城市规划区范围外的农村村民住宅建设，应当编制村庄、集镇建设规划，并按照规划和集约用地的要求实施。鼓励集中建设农民新村和旧村改造。
第五条 村庄、集镇建设规划不得随意调整和变更，各村庄、集镇规划区内的各类建设，必须符合建设规划。在建设公
