摘要 依法治国作为当代中国的根本治国方略具有严格的形式性。研究法治的形式合理性实际上就是研究法治逐渐走向理性的过程。法治的形式合理性是一种客观合理性，具有事实的性质，它是关于不同事实之间因果关系的判断；符合形式合理性的法治被称作形式法治，它不涉及人的主观好恶以及主观上的评价，因此，形式法治可以反对专制特权；形式法治有利于维护实体权利；形式法治有利于确保司法公平；形式法治既是市场经济的要求，又反过来促进市场经济的发展。
