从“人肉搜索”第一案论网络侵权责任问题.pdf分类号学校代码——密级】Q墨生至学号 200801330081 从“人肉搜索"第一案论网络侵权责任问题 TheLegal Issuesof InfringementLiability from‘‘HumanPowered Search’’FirstCase 指导教师姓名、职称奎生达整撞研究方向湖南师范大学学位评定委员会办公室--0一一年九月摘要?III U {Y2047099 随着网络的普及,市民生活与网络信息技术联系的越来越紧密, 一种新的网络搜查方式“人肉搜索”的出现带来了关于网络信息侵权的法制思考。一方面,我国关于网络信息安全的保护立法零散,对于网络隐私权的保护不够彻底,对网络暴力的防治并没有明确的立法支持, 导致大量侵权事件出现,严重危害了基本人权;另一方面,我国的法制监督体系滞后于现代社会的发展,导致网络监督走在“法制"的危险边缘,值得人们思考。本文通过对“人肉搜索”第一案的剖析,采取个案研究法、文献研究法、交叉比对法、信息研究法等论文研究方法对网络侵权责任的法律问题进行研究论述,根据“人肉搜索"引发的隐私侵权行为,提出了对规制“人肉搜索”引发的隐私侵权行为和构建网络侵权责任体系的一些建议。“人肉搜索”网络侵权产生的原因是多方面的,除了道德因素外, 还包括经济、社会、文化等众多因素。网络环境的特殊性使得它的防范更趋复杂,想要有效的防范和消减这些因素,必须依靠全体社会成员的共同努力才能有效保护网络环境的安全。只有从法律调整、管理制度、伦理道德和行业自律等不同角度实施一系列的措施,惟有如此才能真正保护网络环境的安全,防止网络侵权行为的再次发生。关键词:“人肉搜索”;网络信息侵权;立法保护 ABSTRACT Asthepopularity working,public work information technologies ever closer,a new approach tointemetsearch¨Human Powered Search¨has brought aboutthelegalthoughts oftheinfringement the one hand,scattered onthelegislation of protection workinformation security inChina,fortheprotection work privacyrightthoroughenough,on thecontrol work of violenceandtheabsence ofclearlegislativesupport,resulting in alarge number ofviolations occur andseriousharm tothefundamental human on theotherhand,legal supervision system ofChina lags behind developments inmodem societies,work monitor inthe ¨legalsystem”being atrisk,it isworthpeoplethinking about.
