法律与道德长久以来相互依存，如黑夜之于白昼，看来截然两端却又无论如何难以分隔，他们息息相关且相互影响，在历史的发展过程中两者的关系也跟着成为永恒的话题之一了。法律与道德两者相互以螺旋状作用并上升发展，正如人类历史以不可阻碍的步伐前进。
法律与道德在相互磨合中彼此渐渐的区分了开来，但无法避免的是，随着观念的转变，道德标准的更改，法治的进步，法律与道德又开始相互磨合以彼此适应，然后又相互区分。这是一个不可避免的过程，并且是以螺旋状上升并且发展的。
虽然法学家对法律与道德的关系一直颇有争议，但道德对于法律的作用是无法忽视的，即便许多人极力的回避这一问题。法律是道德的下限，也就是说，当一种行为侵犯特定的社会关系或社会秩序，仅靠道德约束和谴责已不足以制止时，就需要将该道德规范确认为法律规范，运用国家强制力来予以实施。如在市场经济条件下，当诚实信用道德规范已不能有效遏制信用严重滑坡时，就需要将诚实信用确认为《民法通则》所规定的法律原则，并通过对欺诈行为进行制裁来保证该法律原则的实施；而当民事制裁已不能有效制止欺诈时，就需要运用刑罚手段来打击诈骗犯罪。但是，法律的下线仅仅是就法律的制裁功能而言的。法律还有另外一个重要
