婚内侵权民事责任制度的选题是从一般民事侵权责任与离婚侵权损害赔偿的理论中引申而来。
家庭的和谐是构建社会主义和谐社会的根底。构建和谐家庭必然要求男女两性的平等和谐。然而，在现实生活中，夫妻之间侵权问题的日益凸现，这些问题破坏了夫妻之间的平等和谐，防碍了家庭的稳定，也成为了构建社会主义和谐社会的障碍。从司法实践来看，婚姻当事人如果不想离婚，只想追究夫妻一方侵权行为的损害赔偿责任，其请求权难以实现。是故，面对夫妻之间侵权事件的大量涌现，婚姻立法需要解决如何对受害当事人进行司法救济的问题，以遏止夫妻之间侵权行为的发生，维护家庭的和睦，社会的和谐。为此，借鉴国外立法，从中国实际出发，结合我国司法实践，从理论上构建完善的婚内侵权民事
