〔一〕宅基地面积标准
村民建房必须符合“一户一宅〞的原那么，宅基地面积包括住宅和附属用房、庭院用地。宅基地建筑占地面积标准为：
大户〔6人及以上〕不得超过120平方米，中户〔4至5人〕不得超过100平方米，小户〔3人及以下〕不得超过80平方米。
〔二〕村民建房的建筑层次
建筑层次根据规划确定，原那么上不得超过3层，。半地下室、〔〕的按1层计算。
〔三〕人口核定按申请建房户在册常住农业人口计算，有以下情况的可区别对待：
1、未婚独生子女凭有效证明可按2人计算。
2、符合单独分户条件且已婚〔均属农业人口〕尚未有子女的，凭结婚证可

3、家在农村的在校学生或回村落户的高校、中专毕业生和转业复退军人，或家在农村的应征入伍的义务兵及服刑人员可计入申请建造住宅用地人口数。
四、建房条件
村集体组织成员,符合建房条件的，可向其户口所在的村集体组织申请建房。有以下情形之一的，可以认定符合建房条件。
1、同户常住人口中已领取结婚证书，确需分户建房的；
2、因规划实施需要调整该村民户原住房位置的；
3、符合规划，确需改善居住条件的；
4、原住房因自然灾害等原因损毁或属于危险房屋；
5、经批准回乡定居的港澳台胞、华侨、外籍华人等需要建房，依法可参照执行的；
6、原户口在本村的未享受过住房安置政策的征地农转非人员、小城镇户改人员；
7、法律法规规定的其他情形。
〔二〕有以下情形之一的，其申请不予
1、村民将原住房出卖、出租、赠与他人或者将原住房改作他用的；
2、曾以所有家庭成员作为一户申请建房被批准后，不具备分户条件或者不合理分户的；
3、同一行政村身边有子女的老年人单独申请建房的；
