 约定解除是指在合同依法成立而尚未全部履行前,当事人基于双方约定的事由行使解除权而解除合同。约定解除权的根本特点在于:当事人在合同中约定了合同解除的条件,而当约定的条件出现时,当事人即可行使解除权而使合同解除,因此,约定解除属于单方解除。
 
 (3)法定解除
 
 法定解除是指在合同依法成立后而尚未全部履行前,当事人基于法律规定的事由行使解除权而解除合同。法定解除是与约定解除并列的一种单方解除合同的方式,其根本特点在于:由法律直接规定解除合同的条件,在具备条件时,当事人可以行使解除权以解除合同。
