摘要
作为现代生殖技术发展的产物,代孕的现实处境是:一方面,它具有极大的应
用价值和市场需求,并且积极服务于不孕人群;另一方面,它面临着来自伦理道德
的声讨和法律政策的禁止,从而引发了激烈的社会争议。本文认为代孕是一种潜在
的社会需要,绝对地禁止任何形式的代孕是不切实际的。运用法律手段来全面禁止
代孕行为,这不仅不能避免该行为的发生,反而可能造成更多的问题,并且,强大
的市场需求还可能导致这种禁止令形同虚设。因此,只有将这种政策的“外在性”
内在化,才能起到良好的效果。
本文首先介绍了代孕产生的背景及其引发的社会、伦理问题,随后介绍了不同
伦理分析背景下各国立法的差异;第二章梳理了母亲、自主性等相关概念,提出了
代孕的定义,界定了代孕技术解决不孕症的范围。在第三章的伦理分析中,本文尽
量做到细化,分析了与代孕有关的不同的伦理争议,最后得出结论:赞成非商业化
利他——合理补偿型的借腹代孕,因为在这种情况下,借腹代孕可以满足不孕夫妇
想要一个与自己有血缘关系的后代的愿望,其所依据的伦理立场是可以得到辩护的。
基于这一结论,最后一章提出了在我国进行相关立法的建议。

Abstract
As a product of the development of the modern surrogate technology, surrogacy
confronts the situation as: on the one hand, it has great application value and market
demand, at the same time, it actively serves the people of infertility; on the other hand, it
faces the moral condemnation and the legal prohibitions, causing the fierce social
controversy. This paper argues that surrogacy is a potential social needs, and in practice,
the absolute prohibition of any form of surrogacy is not unpractical. The legal total ban not
only fails to prevent the surrogacy, but may cause more issues. Moreover, the powerful
market demand will make such prohibition useless. For a legal policy to make effect, it is
necessary to internalize the external laws.
This article is divided into 4 chapters. The first chapter introduces the background of
the development of surrogacy and its social and ethical issues, then describes the context
of different ethical analysis of differences in national legislation. The second chapter
analyses concepts of mother and autonomy in the relation to surrogacy, defines the
surrogacy, and determines the range in which the technology of surrogacy is used to solve
