摘�要�
�
安乐死是一个热门话题一直受到无论是赞成的还是反对的
学者的高度重视特别是从��年起几乎在每年的全国人大
会议上都有代表提出关于安乐死的立法提案安乐死合法化的呼
声日渐高涨但关于安乐死的提案一直未被立法者正式地予以讨
论个中原委颇值研究�
本文试图对此作一初步的分析和研究本文首先对我国学界
有关安乐死的研究现状作一简要的梳理与评述旨在说明如果
我们尚未从理论上搞清楚安乐死那么为安乐死立法或者使之
合法化自然也就无从谈起其次安乐死虽然是一个古老的话题
但它之所以历久弥新争论不休不能不说是既得益于医学技术
的长足发展又受困于现代医学技术与传统道德之间的紧张并
且依我个人所见恰恰是这种紧张�制约着安乐死合法化
的进程再次众所周知荷兰作为全球第一个正式在法律上将
安乐死合法化的国家对我们这个后进的法律社会来说无疑极具
分析价值自然也就成为本文重点要涉及的内容特别是其完备
健全的医疗卫生和社会保障体系以及医界高尚的道德情操和社
会责任感恰恰是我们当下所缺乏的法律内生于社会生活它
是文化的产物�
正因为如此本文认为我国目前尚不具备安乐死合法化的
条件安乐死合法化应当缓行当务之急是大力发展适合我国国
情的临终关怀事业�

ON LEGALIZING EUTHANASIA IN CHINA

ABSTRACT


Euthanasia is a much-talked issue nowadays. Many scholars have
been paying much attention to it, of course, some of them are arguing for
it, while some others are arguing against it. Since 1994, in almost every
year’s National Congress, there are some representatives putting forward
the euthanasia legislation motion. The voice of legalizing euthanasia is
ing louder and louder. However, the motion of euthanasia has
never been officially discussed by legislators . The reason why they do so
is worthy of studying.
In this dissertation, the author attempts to analyse and explore this
phenomenon. First, the present situation of euthanasia study in Chinese
academic field has been briefly methodized and reviewed to explain a
very fact: It is useless to legislate euthanasia or legalize it before we
theoretically make clear what euthanasia is. Second, old topic as
euthanasia is, it is a much-talked issue for many years. We have to say
that it not only does good to the development of medical technology, but
it is also held up by the tension of modern medical technology and
traditional moral. In addition, from the view point of the author, It is this
