作者简介:陈公绰,1923年出生。1945年毕业于武汉大学法律系,1947年至1950年先后在瑞士的洛桑大学法律系、日内瓦大学法律系和法国的巴黎大学法学院研究院学习。曾在外交部国际关系研究所从事研究和译校工作,曾任贸促会法律顾问部兼职律师。陈公绰同志是国内为数不多的精通英、法语的法律专家之一,曾多次赴联合国机构工作,成绩斐然,在联合国获得很高评价。他主编的《英汉法律政治经济词汇》成为联合国各机构中文部门的必备工具书。
本文所谈到的法律文件,除了法律、规章、条例以外,还包括条约、协定、合同、章程、保证书、判决书等等。在联合国范围内则有国际法院的判决和咨询意见,大会和安全理事会的决议,联合国国际法委员会草拟的条款草案和其他文件等。
一、翻译英文法律文件所遇到的问题
翻译英文法律文件所碰到的问题或困难,有两个方面,一是语文方面的问题,二是专业方面的问题。
从语文方面来说,法律文件的语法结构往往比较复杂,句子长,大句套小句,小句套分句,有时一句就占一页,甚至不止一页。起草法律文件的人似乎很怕有什么遗漏,被人钻空子,往往喜欢写得非常繁琐,面面俱到,包括一切的可能性。例如一个公司章程中关于公司目的的条款中的一项:
"To purchase, take on lease or in exchange, hire or otherwise acquire and hold for any estate or interest, any lands, buildings, easements, rights, privileges, concessions, patent rights, licences, secret processes, machinery, plant, stock-in-trade, or any real or personal property of any kind necessary or convenient for the purpose of or in connection with pany's business."
这里连用了几个动词purchase(购买)、take on lease or in exchange(租赁、换取)、hire(租用),还要加上or otherwise acquire(或以其他方式取得)。关于动词的宾语列举lands(土地)、buildings(建筑物)、easements(地役权)、rights(权利)、privileges(特权)、concessions(特许)、patent rights(专利权)、licences(许可)、secret processes(秘密工艺)、machinery(机器)、plant(工厂)、stock-in-trade(存货),这还不够,还要说any real or personal property of any kind (各种动产或不动产)。说了necessary(必要),还要说convenient(方便),说了for the purpose of (为了),还要说or in connection with(或涉及)。
又例如一个租赁合同中关于保证对出租人给予补偿的条款中的一部分:
"Against all liabilities, claims, demands, proceedings, costs or expenses of whatsoever nature which may be made or brought against or incurred by the lessor by reason of any loss, injury, death or damage caused or chaimed to be caused to any person or of any loss of or damage to property occasioned by or arising or claimed to be occasioned or to arise directly or indirectly out of the manufacture, delivery, presence, possession, provision, operation, use, instalment, removal, transportation, replacement or repair of the goods and whether arising or claimed to arise out of defects in the goods or by reason
