摘要
目前中国的农业农村农民问题已经成为政界学术界所关注的热点问题之
一自从上个世纪八十年代后期农业经济出现了滑坡以来学者们开始探讨中国农业
持续发展之路以家庭联产承包制为主要内容的土地制度问题受到了极大的关注本
文通过对农地制度中农地使用权流转的研究试图为“三农”问题找到出路
本文从农村土地的制度变迁历程和农地使用权的各种政策法规的演变轨迹出发
分析了我国农地使用权流转的现状我们发现土地使用权的流转在一定程度上解决
了农地抛荒问题提高了土地利用率和农业生产效益是经济发展的必然趋势当前
不少地方正推进土地使用权流转工作中进行了一些积极探索土地向种田大户和农业
企业集中满足了土地适度规模经营的需要但相当一部分地区还处于自发式的流转
或无序状态农民的土地承包经营权益仍然不断受到侵害如何使土地使用权流转朝
着健康有序的方向发展成为迫切需要解决的问题
本文认为农民土地产权的模糊和流转激励不足制约了农地使用权流转农地使用
权流转既然是一种市场行为就必须遵循市场规律保证农民作为土地流转的主体地
位赋予农户土地承包权物权化的性质让农户自由的流转土地而地方政府乡镇
组织要充分发挥其公共服务的职能促进土地使用权流转市场的建立与完善

Abstract
Nowadays, the problems of agriculture, rural and peasants have been a focus of the
government and academic circle in China. Because rural economics have been declining
since the late 1980s, academicians began to study the way to agriculture's persistence
development in China, the defects of household responsibility system have drawn great
attention. This paper will study the circulation of rural land-use rights, and try to find an
approach to the problems of agriculture countryside and peasants.
Based on the process of rural land institutional change and the evolution of the policies
and regulations about rural land-use rights, this paper analyses the present situation of the
circulation of rural land-use rights in China. It is found that the circulation of rural land-use
rights has solved the problem of neglecting the cultivated land to some extent, and
improved the efficiency of land use and agricultural production profit, which is an
inexorable trend of economic development. At present, many areas are probing some of the
problems actively. The land is concentrated to the more specialized farming household and
agribusiness, which satisfies the needs of appropriate land scale operations. But in a few
