摘要
情谊行为,是人们在社会交往中为增进情谊而产生的社会行为,其概念是
由德国民法首先提出的。一般认为,情谊行为属于道德规制的范畴,不应受法
律规范调整。然而,随着社会不断的发展和社会结构的转型,日常生活中因情
谊行为引发的纠纷和赔偿请求事件不断发生。纵观我国,现有的法律对情谊行
为未做明确规定,学术界对情谊行为的理论研究甚少,造成纠纷的解决十分棘
手,研究情谊行为的必要性和现实性日益突出。
本文分六个章节对情谊行为进行了阐述。首先,从现实案例出发,介绍了
情谊行为的概念及其产生的必要性。其次,本文从情谊行为产生的法理基础即
法律与道德的角度,在引用中西方传统学术的基础上,简要分析了情谊行为下
法律与道德以及与秩序的关系;且本文从事实行为、意思表示的角度初步论证
了情谊行为的性质,并由此得出,情谊行为不能一概被认为属于事实行为或法
律行为,应对此进行具体问题具体分析。第三部分对情谊行为的三个典型类型
进行了归纳,即纯粹的社会交际交往行为、协助或帮助行为和两性私密行为。
第四章为本文的重点部分,阐述了情谊行为的法律后果,并分析了情谊行为与
无因管理和不当得利的不同之处及情谊行为造成损害赔偿的主观要件;最后,
从法律构建基础出发,探讨了情谊行为立法的可行性。

Abstract
Friendship behavior is social behavior which can promote the friendship in social
communication, which concept was first introduced in Germany civil law. In general
the friendship behavior is ruled by moral norm rather than law. But there are a lot of
disputes arise from it with the social development and structural transformation which
cannot be solved with sufficient study and legislation. Therefore it is very important
and necessary to conduct research on this subject.
This paper includes six parts. The first part expounds the definition and necessity
of the friendship behavior through an actual case. The second part analyzes the legal
foundation of the friendship behavior based on parison of the western and
Chinese theory;and analyzes the nature of the friendship behavior from factual
behavior and intent expression behavior aspect which conclude that the friendship
behavior is not purely legal behavior or factual behavior whose nature should be
analyzed case by case. The third part analyze the type of the friendship behavior and
divide it into pure munication behavior, assistance behavior and sexual
private behavior. The forth part is the main part of the paper which includes the legal
effect of the friendship behavior, the difference among the friendship behavior,
