I 英联邦国家的调解制度对我国的启示 摘要 在当代,随着社会主体在价值观和文化传统及利益冲突上的多元化,多元化纠纷解决机制的建立已经成为一个世界性的课题。各国通常把法院以外的各种非诉讼纠纷解决方式统称为替代性纠纷解决方式(ADR) 。调解作为ADR的一种主要形式,与审判一起构成中国的两种主要纠纷解决机制。然而近年来,随着市场经济的活跃与发展,调解制度也暴露出诸多弊端。而西方国家如英国、加拿大、澳大利亚的调解制度发展比较成熟,对于我国有极其重要的借鉴意义。结合我国的法律文化传统和调解发展趋势,科学的吸收其他国家调解制度的合理因素,并在此基础上形成具有中国特色的调解制度。 全文共分为三章: 第一章简述英联邦国家中的英国、加拿大和澳大利亚这三国的调解制度。 第二章从三个方面对这三个国家的调解制度进行比较。 第三章对我国调解制度的发展历史作了简要的概述,以及当今存在的问题,着重阐述了英联邦国家调解制度对我国的启示。 II 关键词:调解,强制调解,调解前置,ADR III THE ENLIGHTENMENT MONWEALTH COUNTRIES’ MEDIATION SYSTEM ON OUR COUNTRY ABSTRACT Nowadays, with diversity of the va lues, cultural her itage and conflict of interest , diversification of the dispute settlement mechanism has e a worldwide issue .All countries usually call a variety of non-litigious dispute resolution me thods the Alternative Dispute Resolution (ADR). Mediation as a primary form of ADR, and trial together constitute the two main dis pute settlement mech anism in China. In recent years, however, with the development of the market economy, mediation system has exposed ma ny ings. Meanwhile, the mediation system develops more mature ly in some western countries such as Britain, Canada and Australia, whic h has a very important significance on our country. Therefore, bina tion with the legal cultural tradition and the development trend of the me diation, absorbs the reasonable elements of mediation in other count ries in order to form mediation system with Chinese characteristics. IV This paper is divided into three chapters: Chapter one analyzes the mediati on system in monwealth countries such as Britain , Canada and Australia. Chapter pares the mediation system of these three countries from three aspects . Chapter three gives a brief overview of the history of the development of China's mediation sy stem, as well as the problems of today, emphatically expounds the en lightenment of monwealth mediation system on our country.
