摘要

间谍软件是指安装在用户计算机上的程序,此程序的安装未经用户的同意,
或虽经用户的同意但超出了告知的功能范围,或采用欺诈的方式征得用户的同意,
或者强行运行,或者不能简便地一次性彻底卸载所有功能模块;并且其具有如下
功能:控制、破坏用户计算机软硬件;强制用户行为;监视用户行为、盗窃或以
欺诈的形式骗取用户信息。因受到合同相对性原则的制约,合同法对间谍软件难
以规制,因而间谍软件致损他人,其民事责任主要为侵权责任,应受侵权法调整。
间谍软件侵权具有自身的特殊性。间谍软件侵权行为主体具有复杂性,不同
的主体表现出不同的行为,间谍软件制作者和直接使用者是间谍软件侵权环节中
不可或缺的主体,直接使用者更是其中关键的主体。主体的身份可能存在重合,
在这种情形下,如果其有直接使用间谍软件的行为,则应将其认定为间谍软件直
接使用者。间谍软件制作者仅仅制作间谍软件、传播者仅仅传播间谍软件的行为
没有直接作用于计算机终端用户不构成对用户权益的侵害。间谍软件直接使用者
侵权行为包括:控制、破坏,强制,监听监视,盗窃。中间服务商违反注意义务,
以不作为行为侵犯了用户的权益,应当认定为是间谍软件侵权行为。
间谍软件一般侵权的责任承担方式包括停止侵害,消除影响、恢复名誉,赔
礼道歉,返还财产,赔偿损失。其中直接使用者故意侵权应承担惩罚性赔偿责任。
共同侵权行为人应承担连带赔偿责任,责任承担的方式同一般侵权责任承担
方式。

Abstact

Spyware is a kind of software that installed puter user’puter, it
installed by spyware user puter user’s consentment or although spyware
user puter user’s consentment but the function of spyware is beyond the
function which spyware user tell during the installment ,or use a fraud tell manner to
tell puter user, or force the spyware run , or dosen’t puter user a
method that can easily and fully uninstall all the module of the software ,and its
function s are as follow: control、puter software and hardware; force
computer’s behavior; puter user’s behavior, steal or puter user’s
private information. As restrained by the contractual related concept, contractual law is
hard to control spyware, so, civil liability spyware damage is mainly tort liability,
spyware should be regulated by law of tort .
Compared with other tort, spyware tort has its speciality, and its subject has
complexity, different subject has different delict, spyware user and direct user are
necessary for spyware tort link, direct user is the key figure of spyware tort link.
Subject status may overlap, when overlap occur, if the subject has behavior of direct
