摘 要
维护交易安全和鼓励交易为社会主义市场经济体制下法律理论和实践中无可回避的课题。在现实生活中交易表现出来的现象并非均为实像。为了保护交易安全及保障市场经济的健康发展，表见代理制度即应运而生。由于我国长期实行社会主义计划经济制度的原因，对该项制度以国家立法的形式予以确立时间并不很长，理论界虽也多有论述，但仍有很多法律主体对该项制度不甚理解。本文试对表见代理予以论述与探讨。以期对社会主义市场经济体制下的法律关系主体有所裨益，对该制度的接受由“实然”继而变为“应然”，促进市场经济的快速健康发展。
