动物权利的法理学解析.pdf河南大学硕士学位论文动物权利的法理学解析姓名:宋婧杰申请学位级别:硕士专业:法学理论指导教师:李振江;任瑞兴 20100401 河南大学硕士学位论文中文摘要人与动物的关系是一个古老的问题,世界上不同文明和宗教各有其对动物的思考。在现代社会,经济的迅速发展,入口数量的大幅增加,全球争夺自然资源竞争的日益激烈,人类生存环境的日益恶化,这种变化要求人们对人和动物的关系问题做出新的思考。本文试从法学理论和法律实践入手,分四个部分对此问题进行理论研究和实证分析。第一部分动物权利的论争。本章从动物权利简要介绍引入正文,具体阐述了学界各种主张动物权利的观点和反对动物权利的观点,并试图从二者的一致性中寻找对我们研究相关问题的启示,以期促进我国野生动物保护法和动物福利法的发展。第二部分动物权利的理论依据及其价值追求。本章从自然权利、道德权利和法律权利三个方面寻找动物权利的理论依据及其价值追求,以期为动物权利的法律化(即:将动物权利的理论主张转变为法律)寻找有效途径。第三部分我国动物权利保护法的价值理念及其重塑。本章通过阐述我国现行法中有关动物权利的具体规定及其追求的立法理念,试图突破人类中心主义的思想,重塑我国动物权利保护法的立法理念。第四部分重构我国动物权利保护法律体系。本章具体分析了我国现行动物权利保护法存在的问题,并在此基础上,对构建和完善我国动物权利保护法律体系提出合理的建议。通过以上内容的分析与比较,笔者试图对我国有关动物权利的法律提出一些粗浅的看法和建议。关键词:动物权利;权利保护;生命主体动物权利的法理掌解析 Abstraet The relationship between people andanimals+isanage· on animal rights vary from culture to modem society,with the rapid development ofeconomy and substantial ofpopulation,petition of natural resources es more and more fierce and thehuman environment iS ofthesechanges demand UStorethink therelationship between people and thesistries tomake apositive analysis on thisproblem from the perspective ofthetheoryandpractice oflaw. The second part dealswith thetheoreticalbasisand value three aspects,that is,natural rights,m6ralrights,and legalrights,this chapter introducesthe theoreticalbasisand valueofanimalrights,with the aim atseeking some efficientways ofmaking theoriesconcerning animalrights e thespecific stature. The thirdpart focuses on thevalue andreshaping ofanimal rights inChina. Through accounting forthespecific regulations and the ideas oflegislation ofthe current animal rights inChina,we try toemancipate thehuman.
