第十二条 在公路上增设平面交叉道口，应当经公路管理机构批准；其中在面交叉道口的，应当报经市地以上公路管理机构批准。增设平面交叉道口应按公路工程技术标准修建，并应缴纳有关费用。因公路改造、扩宽需要时，道口使用者必须无条件拆除。
原有的交叉道口，不符合公路工程技术标准或侵占、损害公路的，由道口使用方负责改建。
在公路两侧开办商店、饭店、加油站等从事经营活动的单位和个人，利用公路修建可供车辆出入的道路的，应当按照本条第一款、第二款的规定执行。
第十三条 运输煤、灰土、油料、砂石、化学液体等易遗漏、易抛撒物资的车辆，应当采取防护措施，不得污染、损坏公路。污染、损坏公路的，应承担清理和赔偿费用。
第十四条 在公路上进行施工作业，施工单位应当采取措施维护交通，并在施工路段两端设置明显的施工标志；不能绕行的，施工单位应当修建临时道路，保证车辆和行人通行。
第十五条 公路的护路林，不得任意砍伐，确需更新砍伐的，应当经公路管理机构同意后，依照《森林法》的规定办理审批手续，并完成更新补种任务。
第十六条 公路两侧边沟〔截水沟、坡脚护坡道，下同〕外缘起１．５米的土地为公路用地，由县级以上人民政府确定并依法办理用地手续。
