　　本办法依台湾地区与大陆地区人民关系条例 (以下简称本条例) 第十七条第九项规定订定之。
　　
　　第 2 条
　　
　　本办法之主管机关为内政部。
　　
　　第 3 条
　　
　　申请人在大陆地区使用之姓名与台湾地区原有户籍登记不一致者，应举证确系同一人，并以台湾地区原有户籍登记资料申请；其经死亡宣告者，应于撤销死亡宣告之判决确定后始得申请。审理人员者，由其审查；未派驻审理人员者，由驻外馆处指派人员审查后，均由驻外馆处核转境管局办理。
　　
　　四、申请人在台湾地区者：应由本人或其在台湾地区之二亲等内亲属、配偶或委讬移民业务机构、甲种以上旅行社迳向境管局申请。但依本条例第十七条第三项及第五项规定申请长期居留或定居者，本人应亲至境管局申请。
　　
　　前项第一款申请人在台湾地区无二亲等内亲属、配偶，或遭受家庭暴力取得法院核发之通常保护令者，得由其本人委讬他人、移民业务机构或甲种以上旅行社代为申请。

　　大陆地区人民申请在台湾地区依亲居留、长期居留或定居者，应由依亲对象或在台湾地区设有户籍之二亲等内亲属一人为保证人，并出具保证书。
