　　本方法依台湾地区与大陆地区人民关系条例 (以下简称本条例) 第十七条第九项规定订定之。
　　
　　第 2 条
　　
　　本方法之主管机关为内政部。
　　
　　第 3 条
　　
　　申请人在大陆地区使用之与台湾地区原有户籍登记不一致者，应举证确系同一人，并以台湾地区原有户籍登记资料申请；其经死亡宣告者，应于撤销死亡宣告之判决确定后始得申请。
　　
　　第 4 条
　　
　　大陆地区人民申请在台湾地区依亲居留、长期居留或定居之程序如下：
　　
　　一、申请人在大陆地区者：应向本条例第四条第一项所定机构或依第二项规定受委讬之民间团体在大陆地区设立之分支机构申请，核转内政部警政署入出境管理局 (以下简称境管局) 办理；如无分支机构，应由其在台湾地区之二亲等内亲属或配偶或其等委讬移民业务机构、甲种以上旅行社代向境管局申请。
　　
　　二、申请人在香港或澳门者：应向行政院于香港或澳门设立或指定之机构或委讬之民间团体申请，由境管局派驻之人员审查后核转。
　　
　　三、申请人在海外地区者：应向我驻外使领馆、代表处、办事处或其他外交部授权机构 (以下简称驻外馆处) 申请。驻外馆处有境管局派驻审理人员者，由其审查；未派驻审理人员者，由驻外馆处指派人员审查后，均由驻外馆处核转境管局办理。
　　
　　四、
