导读案例:
我某公司按CIF术语向中东某国出口一批货物,投保了水渍险附加偷窃提货不着险。但在海运途中,因海湾战争,船被扣押。尔后进口商因提货不着而向我保险公司索赔。我保险公司认为不属于保险责任范围,不予赔偿。

自然灾害:是指不以人的意志为转移的自然界力量所引起的灾害,但在海运保险业务中,它并不是泛指一切由于自然力量造成的灾害。按照我国1981年1月1日修订的海洋运输货物保险条款的规定,保险人承保的自然灾害仅指恶劣气候、雷电、海啸、地震、洪水等人力不可抗拒的灾害。 refers to the perils under force majeure such as heavy weather, thunder storm and lightening, tsunami, earthquake, flood, etc.
意外事故:是指由于偶然、非意料的原因所造成的事故。并不是泛指海上所有的意外事故,而仅指运输工具搁浅、触礁、沉没、互撞、船舶与流冰或其他物体碰撞以及失火、爆炸等。are such risks as ship stranding, striking upon the rocks, ship sinking, ship collision, colliding with icebergs or other objects, fire, explosion, ship missing, etc..

一般外来风险是指由于一般外来原因所造成的风险。主要包括:偷窃、提货不着、渗漏、短量、碰损、破碎、钩损、淡水雨淋、生锈、玷污、受潮受热、串味等。 Risks caused by theft, rain, leakage, shortage, breakage, dampness, mildewing, heating, taint of odor, hooking and rusting.
特殊外来风险是指战争,种族冲突或一国的军事、政治、国际政策、法律以及行政措施等的变化。主要包括:战争、罢工、拒收以及交货不到等。Risks caused by on deck, war, strikes, failure of delivery and rejection, etc.
