中南民族大学硕士学位论文 I 摘 要 行政规划作为现代行政的一个重要手段之一,它有利于减少市场机制的盲目性,对防止“市场失灵”也有重要作用。同时,我们也必须认识到其局限性。行政规划作为行政权力行使的一种方式,如果这种权力被滥用,可能会损害行政相对人的权益,此外,若不当使用行政规划这种行政手段,则势必会对社会资源造成巨大浪费。还有,目前理论上对于行政规划的基本范畴研究仍然存在很多争议甚至空白,如行政规划的界定、性质、程序、效力、救济等。因此,有必要深入研究行政规划相关理论问题,使其运行在法治的轨道上,更好地服务于法治社会与和谐社会建设。本文通过对行政规划的基本理论和现状进行介绍,对其存在问题进行分析的基础上,对行政规划法律的规制进行了初步探讨。 本文分为三部分。第一部分主要对行政规划的基本理论问题进行了阐述。首先通过分析国内外学者对行政规划的描述, 对行政规划的概念进行了解读,深入探讨了行政规划的特征、类型,并在此基础上详细分析了行政规划的作用。第二部分主要论述了行政规划现状及法律规制的必要性。这部分首先对我国行政规划的立法现状进行了梳理,接着深入分析了我国行政规划存在的问题。最后阐述了行政规划法律规制的必要性。第三部分是对行政规划进行法律规制的思考。此部分是论文的是重点。此部分首先阐述了行政规划法律规制的基本原则,接着从完善行政规划裁量权、加强行政规划的请求权权利保障、建立完善的行政规划救济机制三个方面进行了深入分析。关键词: 行政规划; 法律规制; 基本原则; 论行政规划的法律规制 II Abstract Chief executive planning as an important means of modern one, it helps to reduce the blindness of the market mechanism, to prevent "market failure" has an important role.
