摘要
国际货物运输作为高风险行业,从一开始就受到海上保险的庇护。货物险,作为海上保险中的一个重要险种,在海上运输中起着十分重要的作用。为了适应国际贸易的发展,很多国家都制定了与此相关的货物保险条款。伦敦协会货物保险条款是其中最著名,最有影响力和最通用的一个。尤其现行1982年条款更是备受推崇。虽然如此,协会仍然在2009年推出新版的协会货物保险条款,以适应当前的形势。新版条款的推出必将对国际贸易中各方的利益产生影响。本文正是通过比较新旧条款的差异,探讨新条款的变化对保险各方以及某些案例的影响。
本文分为五部分,第一部分是引言部分,用以引入写作主题、表明写作目的。第一章主要是对相关的知识背景做了总结,并且对2009年协会货物条款做了简要的介绍,包括2009年条款中没有发生变化的重要条款;第二章主要介绍2009年条款中对被保险人有利的修改及其影响。第三章主要介绍2009年条款中对保险人有利的修改及其影响。结论部分,通过前面的论述,最后得出简要的结论,即完善和修改我国海运货物保险条款势在必行,我们应该顺应国际趋势,货物新条款的规定,对我国条款加以完善。总的来说,2009年协会货物保险条款相比于1982年协会货物保险条款的改变不是特别大,有接近一半的条款是没有发生变化的,相比来说对被保险人有利的条款比较多,所以被保险人货主可以在适当的时机灵活的使用2009年协会货物保险条款,以达到自身利益的最大化。
论文以发现问题、分析问题、解决问题为线索,主要采用对比分析的研究方法,将协会货物保险条款1982版和2009版进行比较研究,以达到借鉴之效果,促进中国海上保险的发展。

ABSTRACT
As a high-risk industry, international carriage was sheltered by marine insurance at the very beginning. Insurance of cargo is an important sort of marine insurance, which is of importance in shipping industry. To modate with the development of international trade, many countries have constitute cargo clauses for insurance, in which institute cargo clauses of London(ICC) is the most famous, universal one, especially ICC1982. Nevertheless, the institute released ICC new edition in 2009 to modate with situation nowadays. So, new clauses will result in different interest assignment. This thesis is about to discuss the effect of the clauses update to insurance parties and some cases paring the two editions.
This thesis is divided five parts. The first part is foreword, introducing the subject which is going to be discussed and showing the object of this thesis. Chapter one mainly summarizes relative background,and introduces ICC2009, including important clauses unchanged in ICC 2009 edition. Chapter two mainly introduces the update and effect of clauses advantageous to the insured in ICC 2009 edition. Chapter three mainly introduces the update and effect of clauses advantageous to the insurers in ICC 2009 edition. In conclusion, we have got that
