中文摘要摘要随着时代的变迁、社会的发展,我国经济、文化发生了极大变化,财富越来越多,财产的范围和种类日趋扩大。2001年修改后的《中华人民共和国婚姻法》关于夫妻共同财产范围的规定,顺应了当时社会的要求,对法定夫妻财产制中双方共同所有的财产和一方个人所有的财产的范围等,做出了较为进步的规定,在一定程度上填补了过去的立法空白,对夫妻财产更加多元化的现状提供了法律依据。然而,修改后的《婚姻法》规定的夫妻共有财产范围显然存在不足,比如对知识产权的预期利益、资格证书等无形资产未纳入夫妻共同财产的范围,这使得夫妻在财产的公平性上失衡,当事人难以充分维护自己的合法财产权利,不利于家庭关系的和谐以及整个社会的发展。因此,笔者通过仔细分析,进一步明确了知识产权的预期收益、夫妻一方通过继承或赠与而获得的财产、价格昂贵的个人生活专用品、婚前财产在婚后的孳息、分居期间各自所得的财产、夫妻一方资格及技能、婚前按揭房的性质,论证了它们到底是纳入夫妻共同财产范围,还是只归夫妻一方所有。通过这些在司法实践中遇到的问题,来探讨如何进一步完善我国夫妻共同财产范围的界定,这对夫妻离婚时财产的分割和进一步研究具有指导意义。关键词:夫妻共同财产;范围;归属英文摘要 ABSTRACT Wim thechange ofageanddevelopment of our society,China’S economy and culture have gone through huge changes and social wealth ismore and , property scope and itscategory are ing wider and newly-revised Marriage Law of thePeople's Republic ofChina in2001,which,in conformance with socialdevelopment situation,made relatively progressive stipulations with respect to thescope ofcouple’mon property as well as one party’S(husband orwife) property,to someextent,filled inthegap ofprevious lawsandprovided legalground forever-increasing andvarious forms of couple’,the revisedMarriage Law exposes ings interms ofscope ofcouple’mon example,expected benefit ofintellectualproperty,qualification certificateand otherintangible property ale notlisted incouple’mon property, which causesimbalance ofequality forcouples owning meirproperty,renders difficult forclientstofully defend theirlegal property rights and also not conducive for family relationship’S harmony and theentire society on the above-mentionedproblems,this paper makes detailedanalysis tofurther specify the following issues which include expected benefit ofintellectualproperty,property received intheform ofinheriting or donation,expensive personal daily goods, post-marital fi-uitsofpre·maritalproperty,property attainedduring couple’8separation, husband orwife’Squalifications andskills,quality ofpremaritalmoaga西ng house,and demonstr
