郑州大学硕士学位论文我国行政审批制度改革研究姓名:李枫申请学位级别:硕士专业:行政管理指导教师:郑志龙 20030501 度摘要 y 57178Q 改革行政审批制度的关键在于破除旧的不适应社会进步、阻碍经济发展的制建立新的科学的能更好地适应社会主义市场经济发展要求的制度。本文从阐释行政审批和行政审批制度的内涵入手,在对行政许可和行政审批不同观点进行分析的基础上,提出把行政许可与行政审批视为同一个概念,对行政审批制度做了界定。并从经济体制和行政体制的角度考察我国行政审批制度的变迁,把我国行政审批制度的变迁分为两个时期,对每个时期的行政审批制度进行分析,说明行政审批制度是随着社会的发展而不断变化的。文章指出,行政审批制度的合理性在于弥补市场缺陷,局限性在于它的弊端。行政审批制度失灵的原因是:计划经济管理模式与市场经济体制的矛盾冲突;现行行政审批制度的内容与WTO有关规则的冲突;行政国家行政权无限扩张与建立有限政府的冲突;行政权设租与相对人寻租的冲突。通过概括我国行政审批制度改革的总体状况,总结改革的现状和成效,发现改革中出现的问题。在此基础上,针对我国行政审批制度的弊端和改革中出现的问题,提出我国行政审批制度改革的对策:明确取向;界定标准和范围;加强制度建设;发展中介组织;借攀国外经验。本文的创新之处是:1、提出把准备程序和监管程序纳入行政审批程序:2、提出新的制度。关键词:行政审批;行政许可;行政审批制度;改革 Abstract The key point oftheadministrative approval system reformation is tobreak with theoldsystem and establish new scientificsystem tomeet therequirement forthedevelopment ofsocialismmarket economy. Based on expatiating concepts of administrative approval and administrative approval system,this paper is to study the changes of the administrative approval system of China,tO analysis the rationality and limitations oftheadministrative approval system,to study thedeep reasons that make the administrative approval system summarizing the administrative approval system reformation ofChina,to find new problems existing ,some suggestions have been made forthe reformation. This paper consists of firstpart is toexpatiate concepts of theadministrative approval system second part is tostudy the changes of theadministrative approval ofChina from theangels ofeconomic system and administrative paper indicates thattheadministrative approval system of China isdivided into two periods,to show that the administrative approval system ischanging with thedevelopment ofthesociety. The third part is to analysis the advantages and the limitations of the administrative approval paper points that the base of the administrative approval system is to remedy the defect of the exposing thedisadvan
