摘要
对“建筑物区分所有权”中的“专有所有权”的相应理论内容加以分析,针对理
论界存在的对专有权范围认定模糊的现状,明晰专有权的具体范围。对现今业主专有
权受侵犯的现状,可将根据侵权分为:小区开发商对业主专有权的侵犯;小区物业管
理企业对业主专有权的侵犯;其他业主对业主专有权的侵犯。针对不同侵权主体的侵
权行为,笔者依据具体情况具体分析。对开发商侵犯业主权益的问题,通过借鉴多国
相关法律以完善我国现有相关法律制度,明晰产权分割,以减少侵权的产生。对小区
的物业管理企业在行使物业服务过程中由于作为或者不作为因素导致侵权的发生,笔
者建议通过采取多种措施以平衡业主与小区管理者的法律关系,维护双方权益。对于
来自其他业主在行使自己的专有权过程中侵犯其他业主专有权的情形,笔者建议应通
过明确双方权利义务、融洽邻里关系等措施解决。通过理论与实际相结合的完整论述,
达到维护业主专有权的合法权益,完善建筑物区分所有权的研究目的。

Abstract
To analysis the Owners’ Proprietary Ownership of Building Ownership,to identify
theoretical circles for the current existence of the scope of the exclusive rights,clear the
specific scope of exclusive rights. According to infringement about the current status of the
owners of exclusive rights are violated can be classified: residential developers violate the
owners of exclusive rights; residential property pany violates owners’
exclusive rights; other owners violate the owners of exclusive rights. The author based on
specific conditions to infringe violations for different subjects. on the issue of developers’
