内容摘要
犯罪存留养亲,乃是我国古时候所独有的、适用于各个阶层的一种特殊法律制度。该
制度是指对我国古代被判死罪、流罪、徒罪的罪犯,因其父母或者是祖父母年纪老迈,
没有其他成年的子孙、也又没有其他的期亲照顾,所以暂时不执行原判刑罚,将人犯留
下来照顾老人,等老人去世后再执行刑罚的制度。该制度实行的目的,就在于维护封建
的伦理和道德。本文通过细致地研究存留养亲制度的产生的过程、发展的过程、演变的
过程和消亡的过程,从而使我们对中国古代的刑罚制度以及存留养亲制度有比较全面的
认识。同时,通过对该制度所特有的价值和内涵的剖析,明晰该制度存在的合理性和局
限性,从而提出对我国和谐社会创建的借鉴意义。全文除了前言以及结语之外,共分为
三个部分。
第一部分,存留养亲制度的历史演变。本部分按照存留养亲制度产生、完备、承袭、
受限、成熟和消亡的全过程,分六个阶段详细描述了该制度在中国历史上的变迁。同时
结合社会历史背景,对于各时期存留养亲制度存在的差异,进行了较为深入地探析。
第二部分,存留养亲制度的主要内容。本部分通过对不同历史时期存留养亲制度的
例文、律文及案例的分析,探索存留养亲制度的适用范围、成立条件、撤销条件,以及
申请、审理、执行程序。
第三部分,存留养亲制度的存在基础和价值分析。该部分通过对存留养亲制度赖以
存在的思想基础、经济基础和社会政治基础进行分析,指出了存留养亲制度的积极之处
和弊端,提出了对当代和谐社会建设的借鉴意义。

Abstract
Crime remain to support, but our country ancient times exclusively, suitable for each class is a kind of
special legal system. This system is to point to to our country ancient times was sentenced to death, and
