工作场所性骚扰雇主责任研究中文摘要中文摘要工作场所性骚扰(亦称“职场性骚扰")作为性骚扰的主要表现之一,是在20 世纪70年代随着妇女解放运动(女权主义)的兴起而首先为西方人所关注的。性骚扰问题目前在我国还是普遍存在且比较严重的,而工作场所性骚扰又是其中最为突出的问题。性骚扰事件对受害劳动者、其他劳动者、用人单位及整个社会所产生的负面影响极为深远。.以美国为首的发达国家和地区在工作场所性骚扰事件中引入雇主责任,并成为防治性骚扰法律制度中有效的救济机制,这无疑为我国提供了可借鉴的成功模式。我国对工作场所性骚扰的理论研究还处于萌芽阶段,法律规制呈现空白状态, 并且对于雇主责任问题存在观点分歧和立法缺失,所以对工作场所性骚扰雇主责任有必要进行探讨和研究。本文从雇主责任作为工作场所性骚扰的法律救济手段入手,围绕工作场所性骚扰雇主责任的理论来源和不同类型性骚扰的雇主责任的归责原则等核心问题进行系统阐述,并在总结我国工作场所性骚扰雇主责任制度立法现状与适用上的缺陷的基础上,力图构建我国工作场所性骚扰雇主责任制度, 首先通过立法以明确性骚扰雇主责任,增设雇主安全保障义务的条款,最后提出性骚扰雇主责任制度的完善措施。关键词:工作场所性骚扰雇主责任缺陷构建完善作者:周丽指导教I/(副教授) Abstract The Research 011Employer Liability ofSexual Harassment theWorkplace The Research on Employer Liability ofSexual Harassment intheWorkplace Abstract Sexual harassment in the workplace(also known itS”workplace sexual harassment¨)itS themainmanifestation ofsexualharassment,is 70years inthe20th century withthewomen’S liberationmovement(feminism)the riseof theconcems of harassment isstillprevalent in our country andnow more serious,and sexualharassment intheworkplace is one ofthemostprominent problem.
