华中科技大学硕士学位论文 I 摘要小产权房并不是一个法律概念,而是媒体制造的一种特殊的概念,是指在城市郊区由集体经济组织在本集体土地上集中建设或是集体经济组织成员在宅基地上建设后以较低的价格向城市居民销售的,办理了仅有乡(镇)政府或村委会的盖章,而没有国家房地产部门的盖章的小产权证的房屋。由于巨大经济利益的驱使以及城市商品房价格的上涨,小产权房的数量也不断增加。小产权房是我国农村集体土地所有制度框架下出现的特有现象,也是在我国社会经济迅速发展过程中,城市化进程加快、城乡二元经济结构以及新农村建设大背景下产生的问题。虽然政府曾多次发文禁止小产权房,但是由于法律对小产权房问题规定的模糊, 使得小产权房问题处于法律的边缘地带, 并因此产生了一系列的问题。小产权房问题涉及我国的土地制度特别是农村集体土地制度,对它的研究也具有重要的理论意义。而在中央高度重视三农问题的解决以及强调建设社会主义新农村的背景下,对这一问题的研究也有非常重要的现实意义。 对于小产权房问题的解决,有学者提出来实现其合法化的思路,但是合法化并不是解决小产权房问题的特效药,小产权房合法化有其积极的一面,但是也存在消极影响。本文从小产权房的概念产生背景、发展现状出发,揭示小产权房存在的主要问题,剖析其产生原因,在综合权衡小产权房合法化利弊的基础上提出解决小产权房问题的原则与立场,并在此基础上提出解决小产权房问题的制度构建。 关键词: 小产权房 成因 合法化分析 制度构建 华中科技大学硕士学位论文 II Abstract Small property estate is not a legal concept, but the media made it a special concept. It is built by village and town governments alone or with the building developers. Due to the enormous economic profit and the mercial house price rises, the number of small property right is increa sing. The small property right house is an endemic phenomenon appears under the Rural La nd Ownership System of China, it is also an issue arisen in the background of rapid soci oeconomic development, in the process of urbanization, urban-rural dual economic structure and New Rural Construction. Although the gov ernment has repeatedly i ssued a document to ban small-property rights, but because of legal provisions on the housing problem of small fuzzy property rights, making house property fringe issue in the law, and therefore produced a series of problems. As the house property involves land system in China, especially rural collective land system, its research also has important theoretical significance.
