村委会选举之村民选举权利救济的分析研究.pdf

内容摘要本文首先分析了权利救济的基本理论,阐述了权利救济的概念和三种主要方法,简要阐述了当代权利救济理论的主要内容。认为“有权利必有救济”的古老法谚至今仍有实际意义,法律不仅要宣示权利,同时还应该配置相应的救济制度。其次,本文探讨了村委会选举之村民选举权利救济的法律性质。认为村民选举权是村民依法享有选举村民自治组织成员的民主政治权利,也是宪法规定的村民基本权利。因此对村委会选举纠纷应采取政治解决模式和法律解决模式有机结合,二者缺一不可。再次,本文重点分析了我国村民选举权利受侵害的现状、类型和原因。认为侵害村民选举权利的行为主要有两大类,即行政主体侵害村民选举权利的违法行政行为和其他主体侵害村民选举权利的选举违法行为,并具体分析了各自的性质、法律特点及其表现。文章深入分析了村委会选举中村民选举权利易受侵害的原因,主要有法律不完善、宣传组织工作不够深入等原因。最后,文章考察了我国村民选举权利救济制度的现状和存在的问题,认为现行的制度安排既不利于保护村民选举权利、保障村民自治的顺利开展,也与现代法治的基本精神和民主的内在要求相违背,与党的依法治国方略和十六大精神相违背,应当及时加以改进和完善。要建立健全的村民选举权利救济制度, 需要引入选举诉讼机制。应当明确我国现行刑法上的“破坏选举罪”同样适用于村委会选举,加强对村民选举权的刑法保护,现行民事诉讼法对选民资格案件的规定也应当扩大适用于村委会选举,还应当将村委会选举争讼纳入我国行政诉讼的可诉范围。应当加强行政救济在解决村委会选举纠纷中的作用,建立有关村委会选举的行政复议制度,完善村委会选举的信访救济。应当加强国家权力机关对村民权利的救济,建立人大监督救济制度。此外,还应当加强村委会选举中的行政指导、行政处罚和行政处分等救济途径。关键词:村民自治;村委会选举:村民选举权:权利救济;违法行为 Abstract paper analyses the basi c theory ofthe Right Relief and expound its concept and three main ways and its main writer thinks that the old saying“there isrelief”is still practical and the law shall not only declare the right but also dispose the appropriate relief system.
